Monstera Nightlife LLC — Terms & Conditions (Event Entry Agreement)

PLEASE READ CAREFULLY — IMPORTANT LEGAL NOTICE

By purchasing a ticket to, RSVPing for, or entering any event or venue hosted, promoted, or operated by Monstera Nightlife LLC — including Sea Wolf (19 Wyckoff Ave, Brooklyn) and any other venue where Monstera hosts an event (each, a "Venue," and collectively with Monstera's events, the "Event(s)") — you agree to the following terms:

1. Assumption of Risk

Attending an Event involves inherent risks, including but not limited to falls, collisions, crowd-related incidents, exposure to loud sound and lighting effects, and potential injury. These risks may result in serious harm or death. By entering, you voluntarily and knowingly assume all such risks.

2. Waiver of Liability

To the fullest extent permitted by law, you release and hold harmless Monstera Nightlife LLC, its officers, members, employees, contractors, and affiliated entities (including 19 Wyckoff Services LLC and any Venue where an Event is held) from any and all claims, damages, or injuries arising from your attendance, including those caused by ordinary negligence. This waiver applies to you and to anyone attending under your ticket, reservation, or invitation.

3. Waiver for Minors

Our Events are generally restricted to guests 21 years of age or older. If a specific Event permits minors and you bring a minor guest, you represent that you are their parent or legal guardian, or are otherwise authorized to act on their behalf, and you agree to waive all claims on their behalf to the same extent as set out in Section 2.

4. Third-Party Beneficiaries

Anyone attending an Event under your ticket, reservation, or invitation is considered a third-party beneficiary of these Terms and is bound by them to the same extent as you.

5. Medical Consent

You authorize Venue staff and any medical or emergency personnel present to provide reasonable medical attention or arrange emergency services if necessary during your visit.

6. Indemnification & Insurance

You agree to indemnify and hold harmless Monstera Nightlife LLC and the Released Parties (defined below) against any third-party claims arising from your conduct or attendance at an Event. You are solely responsible for maintaining your own health, property, and personal liability insurance.

7. Entry, Revocation & Refund Policy

Admission is revocable at any time, at the sole discretion of Monstera Nightlife LLC or Venue staff, including for violations of these Terms, posted venue rules, or applicable law. Tickets include non-refundable service charges. All tickets are non-refundable and non-exchangeable except as required by law. If an Event is cancelled without a rescheduled date, ticket holders will receive an automatic full refund to the original payment method used. Purchasing a ticket constitutes agreement with this policy — please confirm Event details before purchasing.

8. ID Policy

A valid, physical, government-issued photo ID is required for entry to age-restricted Events, consistent with New York State law. Digital or photocopied IDs are not accepted. ID information may be checked or scanned as described in our Privacy Policy.

9. Photo & Video Release

By entering an Event, you grant Monstera Nightlife LLC a non-exclusive, royalty-free, worldwide right to photograph, film, and record you, and to use such photographs, video, and recordings for promotional and marketing purposes across any medium, including social media (@monsteranightlife). If you do not wish to be recorded, please notify staff upon entry.

10. Prohibited Items

The following items may not be brought into an Event or Venue:

  • Weapons or illegal substances

  • Alcohol or outside food/drink

  • Skateboards, scooters, or large bags

  • Fireworks, laser pointers, or noisemakers

  • Commercial audio/video recording equipment

  • Animals, except trained service animals

Venue staff reserve final discretion to refuse entry of any item.

11. Rules & Conduct

You agree to follow all posted rules and staff instructions. Abusive, disruptive, or dangerously intoxicated behavior is not permitted. Violators may be removed from the Event without a refund.

12. Code of Conduct

  • No discrimination, harassment, or violence of any kind

  • No eating, gum, or drinking on the dance floor

  • No dancing or physical contact with others while visibly intoxicated

  • Consent is required for all personal interactions — only an enthusiastic yes means yes

Violation of this Code of Conduct may result in immediate removal from the Event at staff discretion, without refund.

13. Promotional Use of Tickets

Tickets may not be used, resold, or advertised for contests, promotions, or other commercial purposes without prior written consent from Monstera Nightlife LLC.

14. Photosensitive Warning

Events may include strobe lighting, fog, and other flashing or intense visual effects. Guests with photosensitive epilepsy or similar conditions should consult Venue staff before entry and take appropriate precautions.

15. Communicable Illness Notice

Attendance at crowded indoor and outdoor events carries an inherent risk of exposure to communicable illness. By entering, you assume this risk and agree to comply with any health and safety protocols posted at the Venue.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Arbitration & Class Action Waiver

Any dispute arising from these Terms or your attendance at an Event will be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. You waive any right to a jury trial and agree not to participate in any class, collective, or representative action against Monstera Nightlife LLC. This arbitration provision is governed by the Federal Arbitration Act and New York State law.

19. Acknowledgment

By purchasing a ticket to, RSVPing for, or entering the premises of an Event, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.

Released Parties

"Released Parties" means Monstera Nightlife LLC, its affiliated entities (including 19 Wyckoff Services LLC), the Venue(s) where an Event is held, and each of their respective owners, members, staff, contractors, volunteers, successors, and insurers.
