Monstera Nightlife LLC ("Monstera," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you: (a) visit monsteranightlife.com or our social media pages (@monsteranightlife); (b) purchase tickets to, or RSVP for, an event we host, promote, or operate; (c) sign up for our SMS or email marketing list; or (d) attend an event or venue where Monstera provides door, security, or promotions services — including Sea Wolf (19 Wyckoff Ave, Brooklyn) and any other venue where Monstera hosts or staffs an event (collectively, the "Services").

This Privacy Policy applies to Monstera Nightlife LLC and, where noted, to the venues and affiliated entities where Monstera operates events ("Partner Venues"). Each Partner Venue may also maintain its own privacy policy for matters outside Monstera's event operations.

This document is a template for general informational purposes and is not a substitute for legal advice. We recommend having a licensed attorney review and tailor this policy to your specific data practices before publishing it.

1. Information We Collect

We collect the following categories of personal information:

a. Information You Provide Directly

  • Contact information: name, email address, phone number, mailing address.

  • Ticketing & reservation information: event(s) purchased or RSVP'd to, ticket type, party size, table/bottle service requests, payment confirmation details (processed by our third-party ticketing and payment partners — see Section 3).

  • Marketing sign-up information: phone number and/or email address you provide to join our SMS or email list, along with your consent preferences.

  • Government-issued ID information: when you enter a venue, our door staff may visually check or scan your ID to verify you meet the legal age requirement and to screen against our safety/ban list. Scanned data may include your name, date of birth, photo, and ID number, depending on the scanning system in use.

  • Communications: messages you send us via email, text, social media, or in person (e.g., customer service inquiries, guest list requests).

b. Information Collected Automatically

  • Website usage data: IP address, browser type, device type, pages viewed, referring URL, and approximate location, collected via cookies and similar technologies when you visit monsteranightlife.com.

  • Analytics data: aggregated or pseudonymous data from tools such as Google Analytics or Meta Pixel used to understand site and campaign performance.

c. Information From Third Parties

  • Ticketing and event platforms (e.g., Eventbrite, Dice, Tixr, or similar) when you purchase a ticket through them for a Monstera event.

  • Social media platforms when you interact with our public pages (e.g., Instagram, TikTok) or use social sign-in.

  • Partner Venues and their door/security staff, for shared safety and ban-list purposes described in Section 4.

2. How We Use Your Information

We use personal information to:

  • Process ticket purchases, RSVPs, and table/bottle service requests, and communicate with you about your reservation.

  • Verify age and identity for lawful entry to 21+ (or age-restricted) events.

  • Operate and enforce our shared safety/ban list across Monstera-affiliated and Partner Venues, so that individuals banned for safety violations at one location can be identified at another.

  • Send you event announcements, promotions, and marketing by SMS and/or email, where you have opted in (see Section 5).

  • Maintain venue safety and respond to incidents, including sharing information with venue security, medical personnel, or law enforcement when necessary.

  • Improve our website, events, and marketing through aggregated analytics.

  • Comply with legal obligations, including tax, licensing, and alcohol-service recordkeeping requirements.

  • Detect, investigate, and prevent fraud, abuse, or violations of our Terms & Conditions.

3. How We Share Information

We do not sell your personal information for money. We may share information with:

  • Service providers who perform functions on our behalf, such as ticketing platforms, payment processors, ID-scanning/guest-list software vendors, email/SMS marketing platforms (e.g., Klaviyo, Twilio), and website hosting/analytics providers. These providers are contractually restricted from using your information for purposes other than providing services to us.

  • Partner Venues and affiliated Monstera entities (including 19 Wyckoff Services LLC and venues we staff or promote events at), solely for event operations, security, and shared ban-list enforcement described in Section 4.

  • Law enforcement or government authorities when required by law, subpoena, or court order, or to protect the safety of guests, staff, or the public.

  • Professional advisors and successors (e.g., in connection with a merger, financing, or sale of business assets).

We do not knowingly share personal information with third parties for their own independent marketing purposes without your consent.

4. Shared Safety / Ban List

To protect guests and staff, Monstera Nightlife LLC maintains a shared safety record ("ban list") that may be accessed by door and security staff across Monstera-operated or Monstera-staffed venues. If you are removed from, or banned from, a venue for a safety, conduct, or legal violation, limited identifying information (such as your name, photo, and the reason for the record) may be retained and shared with other Partner Venues to prevent re-entry. This information is used solely for safety and admission purposes and is not used for marketing. If you believe you have been included on this list in error, you may contact us using the information in Section 12 to request a review.

5. SMS and Email Marketing (TCPA / CAN-SPAM)

If you opt in to receive text messages or emails from us:

  • You will be asked to affirmatively provide your phone number or email and consent to receive marketing messages; consent is never a condition of purchasing a ticket or entering an event.

  • Message frequency varies. Message and data rates may apply.

  • To opt out of texts: reply STOP at any time. Reply HELP for help.

  • To opt out of emails: use the "unsubscribe" link included in every marketing email.

  • We honor opt-out requests promptly and do not sell or rent your phone number or email address to unaffiliated third parties for their own marketing.

Our SMS and email marketing practices comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable carrier guidelines.

6. Cookies and Analytics

Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand site traffic through analytics tools. You can control cookies through your browser settings; disabling cookies may affect site functionality. We do not currently respond to "Do Not Track" browser signals, as no uniform standard has been adopted.

7. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access & Portability: request a copy of the personal information we hold about you.

  • Correction: request that we correct inaccurate personal information.

  • Deletion: request that we delete personal information, subject to legal and safety-related retention needs (e.g., active ban-list records, tax records).

  • Opt-out of marketing: as described in Section 5.

  • Non-discrimination: we will not deny you goods, services, or entry solely for exercising a privacy right (age/ID verification and safety-related admission decisions are not affected by this section).

California residents (CCPA/CPRA): California law grants additional rights, including the right to know categories of information collected and the right to request deletion or correction, for businesses that meet certain revenue or data-volume thresholds. Monstera extends the rights above to California residents as a matter of good practice regardless of whether those thresholds are met.

EU/UK/EEA visitors (GDPR): If you access our Services from the EU, UK, or EEA, our legal bases for processing are your consent (e.g., marketing sign-up), performance of a contract (e.g., ticket purchase), and our legitimate interests (e.g., venue safety, fraud prevention, analytics). You may have rights to access, correct, delete, or restrict processing of your data, and to lodge a complaint with your local data protection authority.

New York residents (SHIELD Act): We maintain reasonable administrative, technical, and physical safeguards designed to protect private information of New York residents, consistent with the New York SHIELD Act, and will notify affected individuals in the event of a data breach as required by law.

To exercise any of these rights, contact us using the information in Section 12. We may need to verify your identity before completing certain requests.

8. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, including: ticketing/transaction records for accounting and tax purposes (typically up to 7 years); active ban-list/safety records for as long as necessary to protect guest and staff safety; and marketing contact information until you opt out or request deletion. We securely delete or anonymize information that is no longer needed.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction, including restricting access to ID-scanning and ban-list data to authorized door/security personnel. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Children's Privacy

Our events and venues are intended for adults (21+ unless otherwise posted) and our Services are not directed to, and we do not knowingly collect personal information from, children under 13. If we learn we have inadvertently collected information from a child under 13, we will delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be posted on our website and, where required by law, communicated to you directly.
